OFFICIAL RULES: Wisconsin Milk Marketing Board Eat. Love. Share. Instagram Contest. Eat. Love. Share. Instagram Contest (the "Contest") is sponsored by Wisconsin Milk Marketing Board ("Sponsor").
PRIZE STRUCTURE: Ten (10) Semi-finalist Prizes – each receive a Wisconsin Dairy Gift Box containing an assortment of Wisconsin dairy products which may include Wisconsin cheese, butter and yogurt. The total approximate retail value of each Gift Box is $100.
One (1) First Place Prize – $3,000
One (1) Second Place Prize – $2,000
One (1) Third Place Prize – $1,000
All federal, state and local laws and regulations apply; void where prohibited. PRIZES MAY BE SUBJECT TO TAX; ALL APPLICABLE TAXES ARE THE RESPONSIBILITY OF THE WINNER.
CONTEST PERIOD: The Contest starts at 12:00:01 AM Eastern Daylight Time (“EDT”) on June 1, 2014 and ends at 11:59 p.m. EDT on June 30, 2014 (the “Entry Period”).
ELIGIBILITY: The Contest is open only to individuals, eighteen (18) years or older at time of entry, who are legal residents of the United States, except residents of Arizona, Florida, Vermont, Colorado, Maryland and North Dakota (the “Ineligible States”). Residents of an Ineligible State and Wisconsin Milk Marketing Board’s directors, officers, employees or agents, their immediate families (defined as parents, children, siblings, spouse and grandparents), and those domiciled with any of the foregoing are not eligible to participate in the Contest.
ENTRY: All entries must be submitted electronically. There are two ways to enter:
Instagram™ Entry. To enter by Instagram™, you must sign into your Instagram™ account, or if you do not have an account, create a free account and then sign into your account. You can create an Instagram™ account by downloading the Instagram application for your IPhone or IPad from the App Store, your Android from Google Play or your Windows Phone from the Windows Phone Store. Once you have signed in to your Instagram™ account you can enter the Contest by uploading a photograph of yourself (alone or with others) with Wisconsin cheese, and/or any other dairy product including butter, ice cream, sour cream, cream cheese, yogurt, whipping cream or milk (each a “Dairy Product”) to Instagram™, tagged with #LoveDairy.
Email Entry. To enter by email, you must email a photo of yourself (alone or with others) with a Dairy Product to firstname.lastname@example.org, with the subject line #LoveDairy. Accepted photo file types include JPG, TIFF or PNG.
All information provided to WMMB by entrant must be complete, true and correct. Limit one entry per entrant. Submissions to the Contest must be received by June 30, 2014 at 11:59 p.m. EDT in order to be eligible; entries received after that date will be deemed ineligible to win. Sponsor is not responsible for lost, late, inaccurate, incomplete, damaged, illegible, or misdirected entries. Each entry must be submitted on an individual basis (i.e., no team, joint, or corporate entries) and all components of the entry must be the original creation of the submitting participant. Only non-commercial work may be submitted. Entries may not contain profanity, nudity, pornographic images, violent images, anti-competition messages, illegal material, or material that violates the rights of third parties. Entries may not include confidential information, trade secrets, trademarks or copyrighted material belonging to any person or entity other than the entrant absent a suitable license or permission agreement, proof of which is required. Entries containing any forbidden matter or material otherwise deemed by Sponsor to be inappropriate will be disqualified. Email entries will be deemed submitted by the authorized account holder of the email address submitted at time of entry.
ROUND 1: A panel of judges consisting of Sponsor personnel will select ten (10) entries as semifinalists based equally upon the criteria of originality, creative use of a Dairy Product and adherence to these Official Rules. Judging will be completed by July 10, 2014 and potential winners will be notified by Instagram™ comment or private message or email on or before July 14, 2014. Sponsor reserves the right not to select any winning submissions based upon the quality or content of submissions. Potential winners and other individuals whose images are included in the potential winner’s entry each may be required to sign and return a sworn Affidavit of Eligibility and Liability and Publicity Release, unless prohibited by applicable law. If required documentation is not returned within seven (7) business days of notification, or if notification is returned as undeliverable, any prize will be forfeited and an alternate winner will be selected.
ROUND 2: The ten (10) semifinalist entries selected by the Sponsor will be made available online for consumer voting at www.Facebook.com/WisconsinDairy beginning at 6:00 p.m.ET July 18, 2014 through 6:00 p.m. ET August 1, 2014 (the “Voting Period”). Consumers may vote for their favorite photo submission based on creative use of a Dairy Product and originality. A consumer is limited to one (1) vote during the Voting Period. Semifinalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, paying for votes; offering sweepstakes/contest entries, prizes or inducements; agreeing to exchange votes with another person; offering any consideration or incentive of any kind whatsoever to persons in exchange for votes; or other means, as determined by Sponsor in its sole discretion. Any attempt by a semifinalist, his/her family or friends, or any other individual to obtain votes using any mechanism that violates these Official Rules, or any other kind of fraudulent or inappropriate mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to void the votes in question and/or disqualify the semifinalist in its sole discretion. Votes must be entered manually. Votes generated by script, macro, bot or other automated means or which subvert or impair the integrity of the voting process will be void, as determined by Sponsor in its sole discretion. Voting must be completed by the actual person casting the vote. A person may not vote on behalf of another person.
FINAL SELECTION: At the end of the Voting Period, the panel of judges will award the First Place, Second Place and Third Place Prizes based on the following criteria, which shall be weighted equally:
• Creative use of a Dairy Product
• Consumer Appeal - taking into account each semifinalist’s online consumer votes
All winners will be notified of final prize(s) on or about August 8, 2014. By entering, you agree to be bound by these Official Rules, and that the decisions of the judges are final and binding in all respects. Sponsor reserves the right not to select any winning submissions based upon the quality or content of submissions.
PRIZE AWARDS: Prizes will be awarded within sixty (60) days after winner verification. No prize substitution or transfer is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value, for any reason. Sponsor is required by law to report prize values to taxing authorities; all taxes and any other incidental expenses on prizes are the sole responsibility of each winner.
GENERAL RULES & LIMITATIONS: By entering, you represent that: (i) your entry is your own original work; and (ii) you own or have the rights to convey any and all right and title in any material submitted as part of your entry into the Contest. By entering, you grant to Sponsor a non-exclusive, worldwide, royalty-free license to edit, publish, promote, republish at any time in the future and otherwise use your submission, along with your name and likeness, in any and all media for any purpose, without further permission, notice or compensation (except where prohibited by law). By participating in the Contest, you agree to release Sponsor and its parent companies, affiliates, subsidiaries, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, or misuse of any prize. Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Contest, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes, in any Contest-related materials, or that may limit prize fulfillment or a participant's ability to enter the Contest. Sponsor reserves the right to amend these Official Rules and to disqualify permanently from the Contest any person it believes has intentionally violated these Official Rules.
